Varje sam\u00e4gare har en viss andel, men andelen \u00e4r inte knuten till en viss del av egendomen. Det \u00e4r viktigt att sam\u00e4garna \u00e4r inskrivna i Registro de la Propiedad (fastighetsregistret) och att de registrerar hur stora andelar var och en av dem \u00e4ger. Om tvist uppst\u00e5r och sam\u00e4gander\u00e4tten inte \u00e4r registrerad kan det inneb\u00e4ra problem som inte g\u00e5r att avhj\u00e4lpa.<\/p>\n<p>Vilka r\u00e4ttigheter och skyldigheter har var och en av sam\u00e4garna?<br \/>\nVarje sam\u00e4gare har r\u00e4tt att anv\u00e4nda fastigheten f\u00f6r det \u00e4ndam\u00e5l som den \u00e4r avsedd f\u00f6r, under f\u00f6ruts\u00e4ttning att anv\u00e4ndningen inte strider mot kollektivets intressen och att den inte begr\u00e4nsar de andra sam\u00e4garnas r\u00e4ttigheter. D\u00e4rf\u00f6r b\u00f6r sam\u00e4garna sinsemellan komma \u00f6verens f\u00f6r att avg\u00f6ra vem som f\u00e5r anv\u00e4nda fastigheten vid varje tillf\u00e4lle och f\u00f6r vilket \u00e4ndam\u00e5l. Varje sam\u00e4gare \u00e4r skyldig att betala utgifter f\u00f6r underh\u00e5ll i f\u00f6rh\u00e5llande till sin andel. Befrielse fr\u00e5n denna skyldighet \u00e4r endast m\u00f6jlig om man avst\u00e5r fr\u00e5n sam\u00e4gander\u00e4tten.<\/p>\n<p>M\u00e5ste alla beslut fattas gemensamt?<br \/>\nF\u00f6r att svara p\u00e5 denna fr\u00e5ga m\u00e5ste man f\u00f6rst veta vilket beslut som ska fattas.  En sam\u00e4gare kan, utan att ha st\u00f6d av majoriteten av r\u00f6sterna, besluta \u00f6ver reparationer som genomf\u00f6rs i syfte att bevara och underh\u00e5lla fastigheten. Om beslutet g\u00e4ller f\u00f6rvaltning eller reparationsarbeten som ut\u00f6kar fastighetens anv\u00e4ndningsomr\u00e5de (till exempel att anlita en tr\u00e4dg\u00e5rdsm\u00e4stare), m\u00e5ste man ha st\u00f6d av majoriteten av r\u00f6sterna. F\u00f6r att genomf\u00f6ra f\u00f6r\u00e4ndringar som p\u00e5verkar fastigheten (till exempel att s\u00e4tta upp ett v\u00e4xthus), kr\u00e4vs samtycke fr\u00e5n alla sam\u00e4gare, \u00e4ven om f\u00f6r\u00e4ndringen inneb\u00e4r f\u00f6rb\u00e4ttring av fastigheten.<\/p>\n<p>Kan en sam\u00e4gare s\u00e4lja sin andel?<br \/>\nVarje sam\u00e4gare kan fritt disponera \u00f6ver sin andel. Allts\u00e5 kan varje sam\u00e4gare s\u00e4lja sin andel, men man m\u00e5ste alltid respektera att de andra sam\u00e4garna har f\u00f6rk\u00f6psr\u00e4tt. I praktiken \u00e4r det sv\u00e5rt att hitta en k\u00f6pare av en andel i en fastighet, i st\u00e4llet f\u00f6r en best\u00e4md del av fastigheten eller av tomten.<\/p>\n<p>Finns det n\u00e5gra andra s\u00e4tt f\u00f6r en sam\u00e4gare att g\u00e5 ur sam\u00e4gandeskapet?<br \/>\nIngen sam\u00e4gare \u00e4r skyldig att stanna kvar i sam\u00e4gandeskapet. Dock \u00e4r sam\u00e4garnas m\u00f6jligheter helt beroende av om det \u00e4r m\u00f6jligt att dela fastigheten eller ej. Om det \u00e4r m\u00f6jligt att dela fastigheten, har sam\u00e4garen r\u00e4tt att n\u00e4r som helst kr\u00e4va att fastigheten delas. Juridiskt sett genomf\u00f6rs delningen genom underskrift av dokument som utf\u00e4rdas av notarius publicus och som d\u00e4refter skrivs in i Registro de la Propiedad (fastighetsregistret). Det \u00e4r m\u00f6jligt att vissa delar av tomten (till exempel tr\u00e4dg\u00e5rden) forts\u00e4tter att \u00e4gas gemensamt. Om fastigheten inte kan delas (till exempel om den \u00e4r f\u00f6r liten f\u00f6r att delas i tv\u00e5 bost\u00e4der) m\u00e5ste sam\u00e4garna komma \u00f6verens om vem av dem som ska beh\u00e5lla fastigheten. Den sam\u00e4gare som beh\u00e5ller den fullst\u00e4ndiga \u00e4gander\u00e4tten m\u00e5ste gottg\u00f6ra de andra sam\u00e4garnas andelar. Om sam\u00e4garna inte kan komma \u00f6verens (till exempel om ingen av sam\u00e4garna har m\u00f6jlighet att k\u00f6pa ut de andra sam\u00e4garnas andelar), ska fastigheten s\u00e4ljas och d\u00e4refter ska f\u00f6rs\u00e4ljningspriset f\u00f6rdelas mellan sam\u00e4garna, i f\u00f6rh\u00e5llande till deras respektive andelar. Detta f\u00f6rfarande kan bli problematiskt om n\u00e5gon av sam\u00e4garna inte vill s\u00e4lja fastigheten.
