Spansk r\u00e4tt g\u00f6r n\u00e4mligen \u00e5tskillnad p\u00e5 hyresavtal som avser permanentbostad och hyresavtal som avser annat \u00e4ndam\u00e5l \u00e4n permanentbostad, s\u00e5som t.ex. semesterbostad eller s\u00e4songsuthyrningsavtal. I den h\u00e4r artikeln behandlar vi endast uthyrning av bostad och inte kommersiella avtal. Hyresavtal f\u00f6r permanentbostad kallas arrendamiento de vivienda och hyresavtal f\u00f6r annat \u00e4ndam\u00e5l arrendamiento para uso distinto de vivienda, bland vilka ing\u00e5r arrendamiento de temporada (s\u00e4songsuthyrning).<br \/>\nMed permanentbostad avses uthyrning av hus eller del av hus (l\u00e4genhet) som hyresg\u00e4sten skall nyttja f\u00f6r sitt hemvist.<\/p>\n<p>Uthyrning f\u00f6r annat \u00e4ndam\u00e5l \u00e4n permanentbostad \u00e4r d\u00e5 f\u00f6r tillf\u00e4lligt boende. Uthyrning av permanentbostad och regler som g\u00e4ller f\u00f6r f\u00f6rl\u00e4ngning av avtalet. Hyrsv\u00e4rden och hyresg\u00e4sten kan fritt avtala om hyresavtalets giltighetstid.<br \/>\nMen om hyrestiden \u00e4r mindre \u00e4n fem \u00e5r sker f\u00f6rl\u00e4ngning av avtalet automatiskt vid utg\u00e5ngen f\u00f6r ett \u00e5r i taget upp till fem \u00e5r.<\/p>\n<p>Om hyresg\u00e4sten meddelar hyresv\u00e4rden att denna inte \u00e4r intresserad av att f\u00f6rl\u00e4nga avtalet, vilket skall ske 30 dagar f\u00f6re avtalets slut, sker ingen f\u00f6rl\u00e4ngning automatiskt av hyresavtalet. Hyresg\u00e4sten kan s\u00e5lunda styra hyresavtalets giltighetstid.<\/p>\n<p>Dock finns f\u00f6ljande undantag:<br \/>\nHyresg\u00e4sten har icke r\u00e4tt till den \u00e5rliga f\u00f6rl\u00e4ngningen om det i avtalet \u00e4r angivet att hyresv\u00e4rden kan komma att f\u00f6r egen eller f\u00f6r n\u00e4rst\u00e5endes r\u00e4kning nyttja den f\u00f6rhyrda bostaden som permanentbostad.<br \/>\nF\u00f6r det fall hyresv\u00e4rden \u00e5beropat detta villkor f\u00f6r bestridande av f\u00f6rl\u00e4ngning kan dock hyresg\u00e4sten p\u00e5kalla f\u00f6rl\u00e4ngning om hyresv\u00e4rden eller n\u00e4rst\u00e5ende inte flyttat in i l\u00e4genheten eller fastigheten inom tre m\u00e5nader fr\u00e5n det att hyresavtalet upph\u00f6rde.<\/p>\n<p>Hyresg\u00e4sten kan ocks\u00e5 i detta fall beg\u00e4ra ers\u00e4ttning f\u00f6r sina kostnader f\u00f6r ut- och inflyttning samt ocks\u00e5 beg\u00e4ra skadest\u00e5nd.<br \/>\nN\u00e4r v\u00e4l de fem \u00e5ren har g\u00e5tt har hyresv\u00e4rden r\u00e4tt att inte f\u00f6rnya avtalet.<\/p>\n<p>Hyresv\u00e4rden m\u00e5ste dock delge hyresg\u00e4sten detta en m\u00e5nad i f\u00f6rv\u00e4g. Om ingen delgivning sker fr\u00e5n varken hyresg\u00e4sts eller hyresv\u00e4rds sida f\u00f6rl\u00e4ngs avtalet \u00e5terigen ett \u00e5r i taget upp till tre \u00e5r.<br \/>\nHyresg\u00e4sten har dock alltid r\u00e4tt att meddela hyresv\u00e4rden sin \u00f6nskan att inte f\u00f6rl\u00e4nga avtalet, vilket m\u00e5ste ske en m\u00e5nad f\u00f6re avtalets utg\u00e5ng varje \u00e5r.<\/p>\n<p>Uthyrning f\u00f6r annat \u00e4ndam\u00e5l \u00e4n permanentbostad<br \/>\nN\u00e4r det g\u00e4ller uthyrning f\u00f6r annat \u00e4ndam\u00e5l \u00e4n permanentbostad, sker detta f\u00f6r en viss best\u00e4md tidsperiod. N\u00e4r v\u00e4l denna period g\u00e5tt ut, kan hyresv\u00e4rden s\u00e4ga upp avtalet och hyresg\u00e4sten har inte r\u00e4tt till f\u00f6rl\u00e4ngning av avtalet.<br \/>\nOm hyresv\u00e4rden vid avtalets slut inte kr\u00e4ver att avtalet skall upph\u00e4vas, kan detta avtal omvandlas till ett avtal f\u00f6r permanentboende. Givetvis medf\u00f6r det, att hyresg\u00e4sten och hyresv\u00e4rden skall r\u00e4tta sig efter det regelsystem som reglerar bl.a. f\u00f6rl\u00e4ngning av hyresavtalet.<\/p>\n<p>Sammanfattning<br \/>\nEtt kort svar p\u00e5 Din fr\u00e5ga \u00e4r d\u00e5 f\u00f6ljande:<br \/>\nDu har inte r\u00e4tt att beg\u00e4ra f\u00f6rl\u00e4ngning av hyresavtalet om Din bostad avser en tillf\u00e4llig bostad f\u00f6r studier, semester m.m.
