Villkoren till\u00e4mpas endast i de fall d\u00e5 referensindexet (vanligtvis euribor) plus den avtalade differensen (exempelvis 0,5%) \u00e4r l\u00e4gre \u00e4n n\u00e4mnda minimigr\u00e4ns Vi tar ett praktiskt och aktuellt exempel: Den senaste euribor som publicerades d\u00e5 denna artikel skrevs uppg\u00e5r till 1,55%. Om differensen som fastst\u00e4lldes i l\u00e5neavtalet var  0,50 % s\u00e5 skulle den f\u00f6r\u00e4ndrade r\u00e4ntesatsen i dessa dagar vara 2,05% (1,55% + 0,50%). Men om vi tillh\u00f6r de otursamma l\u00e5ntagare vars l\u00e5neavtal inneh\u00e5ller klausuler med nedre gr\u00e4ns p\u00e5 3,5%, s\u00e5 kommer r\u00e4ntesatsen till n\u00e4sta uppdatering (som vanligtvis sker \u00e5rligen) inte att vara 2,05 % utan 3,5%. Detta eftersom den sistn\u00e4mnda r\u00e4ntesatsen \u00e4r en orubblig gr\u00e4ns som inte f\u00e5r underskridas. Det myntade uttrycket \u201dbankerna f\u00f6rlorar aldrig\u201d st\u00e4mmer verkligen.<\/p>\n<p>Denna nedre gr\u00e4ns av r\u00e4ntesatsen inneb\u00e4r ett h\u00f6gre belopp att betala varje m\u00e5nad, vilket naturligtvis p\u00e5verkar l\u00e5ntagarnas ekonomi. Vi forts\u00e4tter med samma exempel: Om l\u00e5nebeloppet \u00e4r 200 000 euros och l\u00e5neperioden \u00e4r 25 \u00e5r skulle vi betala 1001,25 euros per m\u00e5nad (om vi till\u00e4mpar den nedre gr\u00e4nsen f\u00f6r r\u00e4ntesatsen, allts\u00e5 3,5 %) ist\u00e4llet f\u00f6r 852,59 euros per m\u00e5nad (om vi till\u00e4mpar r\u00e4ntesatsen 2,05 %). Skillnaden \u00e4r 148,66 euros per m\u00e5nad eller 1783,92 euros per \u00e5r.<\/p>\n<p>Till f\u00f6ljd d\u00e4rav, och i v\u00e5rt exempel, kommer n\u00e4mnda \u00f6verpris att \u00f6ka i takt med att l\u00e5neperioden framskrider de \u00e5r d\u00e5 euribor plus den avtalade differensen \u00e4r l\u00e4gre \u00e4n 3,5% vid det datum d\u00e5 r\u00e4ntan uppdateras, eller med andra ord, alla \u00e5r som eurobor \u00e4r l\u00e4gre \u00e4n 3%.<\/p>\n<p>N\u00e4mnda villkor har f\u00f6rklarats osk\u00e4ligt och d\u00e4rmed ogiltigt i en banbrytande dom som avkunnades av en domstol i Sevilla i september 2010. I domsk\u00e4len anges att orsaken till ogiltigheten inte \u00e4r sj\u00e4lva f\u00f6rekomsten av en minimigr\u00e4ns, utan bristen p\u00e5 proportion och den p\u00e5tagliga obalansen mellan minimigr\u00e4nsen och maximigr\u00e4nsen (som vanligtvis \u00e4r cirka 15%). Med andra ord \u00e4r det n\u00e4stan om\u00f6jligt att n\u00e5 taket p\u00e5 15% om vi tittar p\u00e5 hur r\u00e4ntesatserna har utvecklats historiskt (i synnerhet euribor). D\u00e4remot \u00e4r det mycket troligt att den minimigr\u00e4nsen underskrids, s\u00e5 som den har gjort oavbrutet de senaste tv\u00e5 \u00e5ren (sedan januari 2009).<\/p>\n<p>Faktum \u00e4r att m\u00e5nga klienter bekr\u00e4ftar att de inte k\u00e4nde till f\u00f6rekomsten av en minimigr\u00e4ns eller dess ekonomiska konsekvenser, trots att den st\u00e5r i l\u00e5neavtalet, och klienterna klagar p\u00e5 bristf\u00e4llig information och avsaknad av transparens.<\/p>\n<p>Emellertid har en domstol i Madrid nyligen beviljat en tidsfrist p\u00e5 tv\u00e5 m\u00e5nader f\u00f6r att alla konsumenter som har drabbats av villkor med minimigr\u00e4nser ska kunna inst\u00e4lla sig i en process i vilken de driver en grupptalan om ogiltighet av n\u00e4mnda klausuler. Talan riktas mot 45 finansinstitut. Denna mekanism \u00e4r en m\u00f6jlighet som \u00e4r l\u00e4ttillg\u00e4nglig f\u00f6r alla l\u00e5ntagare eftersom grupptalan inneb\u00e4r l\u00e4gre r\u00e4tteg\u00e5ngskostnader f\u00f6r var och en som deltar. En eventuell gillande dom skulle bara gynna de komsumenter som har anslutit sig till grupptalan.<\/p>\n<p>Vi p\u00e5 IURA kommer att inst\u00e4lla oss i n\u00e4mnda r\u00e4ttsprocess inom den tidsfrist som har beviljats, f\u00f6r att f\u00f6rsvara de m\u00e5nga drabbade l\u00e5ntagarnas intressen. I processen kommer vi att ans\u00f6ka om att respektive finansinstitut upph\u00f6r med att till\u00e4mpa n\u00e4mnda klausul fram\u00f6ver, liksom att de ska betala tillbaka de belopp som l\u00e5ntagarna har betalat till f\u00f6ljd av till\u00e4mpning av klausulen om minimigr\u00e4ns.<\/p>\n<p>Alla anstr\u00e4ngningar som g\u00f6rs i processen kommer definitivt vara v\u00e4rt besv\u00e4ret, d\u00e5 m\u00e5let \u00e4r att ta bort den obalans som f\u00f6rekommer mellan l\u00e5ngivare och l\u00e5ntagare vad g\u00e4ller deras r\u00e4ttigheter och skyldigheter.<\/p>\n<p>Fr\u00e5ga advokaten<br \/>\nDenna fr\u00e5ga \u00e4r besvarad av advokater p\u00e5 IURA:s Advokatbyr\u00e5 som kommer att besvara fler fr\u00e5gor i kommande nummer.
