Detta \u00e4r en bra fr\u00e5ga som man som k\u00f6pare alltid ska st\u00e4lla om man planerar att hyra ut bostaden f\u00f6r semesteruthyrning.<\/strong><\/p>\n<p><strong>Av Christofer Fogelberg, Start Group<br \/>\nchris@startgroup.com\u00a0Tel 952 90 48 90<\/strong><\/p>\n<p>I Andalusien har vi sedan 2016 en lag som reglerar bost\u00e4der som hyrs ut p\u00e5 kort tid, dvs. perioder kortare \u00e4n tv\u00e5 m\u00e5nader i st\u00f6ten.<\/p>\n<p>Lagen s\u00e4ger att om en bostad hyrs ut \u201dregelbundet\u201d (habitualmente) s\u00e5 ska man s\u00f6ka en licens f\u00f6r uthyrning och bostaden m\u00e5ste uppfylla en hel del krav. Bland annat m\u00e5ste den ha okupationslicens (LPO), alla rum m\u00e5ste ha f\u00f6nster, A\/C och\/ eller v\u00e4rme, instruktionsb\u00f6cker till alla vitvaror och elektronik, f\u00f6rsta-hj\u00e4lpen l\u00e5da, turist-information och ett telefonnummer d\u00e4r man kan f\u00e5 hj\u00e4lp av den som hyr ut.<\/p>\n<p>\u00c4garen, eller f\u00f6retaget som hyr ut, m\u00e5ste anm\u00e4la till Junta de Andalucia att man vill hyra ut f\u00f6r att f\u00e5 ett licensnummer (licencia VFT). H\u00e4r uppst\u00e5r ofta problem! \u00c4garen fyller i ett formul\u00e4r d\u00e4r de lovar att de har allting i ordning, \u201ddeclaraci\u00f3n responsable\u201d. \u00c4garen \u00e4r sj\u00e4lv ansvarig om s\u00e5 inte \u00e4r fallet. Det \u00e4r allts\u00e5 inte en ans\u00f6kan som ska godk\u00e4nnas utan alla f\u00e5r ett licensnummer.<\/p>\n<p>Om det sedan blir en inspektion och allt inte \u00e4r i ordning kan man f\u00e5 dryga b\u00f6ter.<\/p>\n<p>Det \u00e4r allts\u00e5 \u00e4garens eget ansvar att kontrollera att bostaden uppfyller alla krav f\u00f6r uthyrning. \u00c4garen (eller f\u00f6retaget som hyr ut p\u00e5 uppdrag av \u00e4garen) m\u00e5ste ocks\u00e5 meddela till polisen vem som hyr l\u00e4genheten inom 24h efter incheckning. Det m\u00e5ste finnas ett enkelt kontrakt d\u00e4r priset \u00e4r specificerat och \u00e4garen m\u00e5ste identifiera de som hyr med pass eller annan legitimation.<\/p>\n<p>Dessa regler g\u00e4ller allts\u00e5 i Andalusien, Decreto 28\/2016, och g\u00e5r under termen \u201dViviendas con fines tur\u00edsticas\u201d. OBS! Om man har fler \u00e4n tre l\u00e4genheter i samma byggnad eller i n\u00e4rheten av varandra klassas det som \u201cViviendas tur\u00edsticas\u201d och de g\u00e5r under lagstiftningen Decreto 194\/2010. Det finns ocks\u00e5 byggnader som redan i stadsplanen klassas som \u201dApartamentos tur\u00edsticos\u201d eller \u201dViviendas tur\u00edsticas\u201d, bost\u00e4der i dessa komplex beh\u00f6ver inte s\u00f6ka en individuell licens men hela komplexet kan bara hyras ut av en akt\u00f6r, som ett slags l\u00e4genhetshotell.<\/p>\n<p>De bost\u00e4der som befinner sig i \u201dvanliga\u201d fastigheter beh\u00f6ver allts\u00e5 anm\u00e4la sig och be om ett \u201dVFT\u201d (vivienda con fines tur\u00edsticas) licens-nummer.<\/p>\n<p>So far so good\u2026 men 2019 best\u00e4mde sig den nationella regeringen att r\u00f6ra om lite extra i grytan\u2026<\/p>\n<p>De best\u00e4mde att bostadsf\u00f6reningarna (comunidad de propietarios) p\u00e5 sitt \u00e5rsm\u00f6te kunde besluta om att f\u00f6rbjuda eller begr\u00e4nsa korttidsuthyrning i komplexet. De kan ocks\u00e5 h\u00f6ja m\u00e5nadsbetalningen med 20% f\u00f6r de som hyr ut p\u00e5 korttid. F\u00f6r att kunna f\u00f6rbjuda beh\u00f6vs att 60% r\u00f6star f\u00f6r att f\u00f6rbjuda eller begr\u00e4nsa, och det g\u00e5r inte att f\u00f6rbjuda retroaktivt. Dvs. de som redan hade en VFT licens kan inte f\u00f6rbjudas att forts\u00e4tta, men de kan h\u00f6ja deras avgift med 20%.<\/p>\n<p>Jag har de senaste tv\u00e5 \u00e5ren sett ganska m\u00e5nga f\u00f6reningar som f\u00f6rbjudit korttidsuthyrning. Det \u00e4r ofta de som tycker det \u00e4r jobbigt att bo i en f\u00f6rening d\u00e4r det hyrs ut mycket, speciellt p\u00e5 sommaren.<\/p>\n<p>Men kallduschen kan komma den dagen man vill s\u00e4lja sin l\u00e4genhet och uppt\u00e4cker att marknadsv\u00e4rdet p\u00e5verkas negativt om man inte f\u00e5r hyra ut. M\u00e5nga k\u00f6pare vill del-finansiera sina semesterbost\u00e4der genom att hyra ut dem, och om man inte f\u00e5r lov blir kanske bostaden oaktuell att k\u00f6pa. F\u00e4rre potentiella k\u00f6pare = l\u00e4gre pris.<\/p>\n<p>Jag var f\u00f6r n\u00e5gra veckor sedan med en av v\u00e5ra kunder p\u00e5 ett \u00e5rsm\u00f6te d\u00e4r det skulle r\u00f6stas om att ha kvar eller slopa f\u00f6rbudet p\u00e5 uthyrning som de hade inf\u00f6rt 2020. Min kund ville att uthyrning skulle till\u00e5tas eftersom han hade en k\u00f6pare p\u00e5 l\u00e4genheten som bara kunde k\u00f6pa om det gick att hyra ut. Med en r\u00f6sts majoritet beh\u00f6lls f\u00f6rbudet \u2013 anm\u00e4rkningsv\u00e4rt s\u00e5 var det flera \u00e4gare som hade licens sedan innan f\u00f6rbudet som r\u00f6stade f\u00f6r att ha kvar f\u00f6rbudet. Det vill s\u00e4ga de f\u00e5r hyra ut men vill inte till\u00e5ta n\u00e5gon annan att konkurrera. Ganska s\u00e5 taskigt tyckte jag\u2026 men den dagen de ska s\u00e4lja f\u00e5r de smaka sin egen medicin eftersom hyreslicenserna inte f\u00f6ljer med bostaden och annulleras vid f\u00f6rs\u00e4ljning.<\/p>\n<p>S\u00e5 om du vill k\u00f6pa en l\u00e4genhet som du ska hyra ut, kontrollera f\u00f6rst att den uppfyller alla krav i enlighet med Decreto 28\/2016 och be om ett brev fr\u00e5n f\u00f6reningen som bekr\u00e4ftar att det inte \u00e4r f\u00f6rbjudet att hyra ut. Om det \u00e4r ok, och du skaffar en VFT licens s\u00e5 f\u00e5r du lov att hyra ut \u00e4ven om f\u00f6reningen senare r\u00f6star f\u00f6r ett f\u00f6rbud.<\/p>\n<p>Om du letar efter en ren hyresinvestering s\u00e5 finns ocks\u00e5 m\u00f6jligheten att k\u00f6pa i ett komplex som \u00e4r klassad som \u201dApartamentos Tur\u00edsticos\u201d, som t.ex v\u00e5rt nylanserade projekt \u201cOxygen Padel &amp; Sports Club\u201d i Calahonda.<\/p>\n<p>Om artikelf\u00f6rfattaren: Christofer Fogelberg \u00e4r spansk m\u00e4klare och medlem i m\u00e4klarf\u00f6rbunden A.P.I. och G.I.P.E.
