Som exempel, var det p\u00e5 en lantegendom m\u00f6jligt att bygga en lada f\u00f6r att f\u00f6rvara mat \u00e5t boskapen, men inte att bygga en villa. D\u00e5 m\u00e5nga struntat i dessa begr\u00e4nsningar har det medf\u00f6rt att det finns m\u00e5nga olagliga bost\u00e4der byggda p\u00e5 denna typ av tomter.<\/p>\n<p>Nuvarande lagstiftning har funnits i \u00f6ver 20 \u00e5r i Andalusien, men f\u00f6r cirka ett \u00e5r sedan kom den nya lagen, Ley del Suelo de Andaluc\u00eda 7\/2021, kallad i allm\u00e4nt tal LISTA. I den nya lagen har inkluderat till\u00e5telse att bygga enfamiljshus p\u00e5 lantegendom, f\u00f6rutsatt att det inte finns risk att marken r\u00f6r sig eller att lantegendomens klassificering och syfte forts\u00e4tter intakt. Lagens f\u00f6reskrifter som beskriver de exakta villkoren f\u00f6r n\u00e4r och p\u00e5 vilket s\u00e4tt det \u00e4r till\u00e5tet att bygga p\u00e5 lantegendom och som vidareutvecklar hur reglerna i lagen ska till\u00e4mpas, publicerades f\u00f6rst i december 2022.<\/p>\n<p>Inledningsvis, kr\u00e4vs erh\u00e5llande av bygglov fr\u00e5n kommunen innan arbetet p\u00e5b\u00f6rjas. Om inget svar ges p\u00e5 ans\u00f6kan inom sex m\u00e5nader fr\u00e5n kommunen, anses det som avslag. Bland annat ska f\u00f6ljande villkor uppfyllas:<\/p>\n<p>a) Endast en bostad f\u00e5r byggas per tomt och byggnaden f\u00e5r inte delas upp i enskilda enheter (tex l\u00e4genheter), med vissa undantag.<\/p>\n<p>b) Tomten m\u00e5ste uppfylla en minimistorlek.<\/p>\n<p>c) Bostaden m\u00e5ste ligga minst 100 meter fr\u00e5n andra bost\u00e4der.<\/p>\n<p>d) Det finns begr\u00e4sning f\u00f6r kvoten p\u00e5 hur mycket som f\u00e5r byggas p\u00e5 resp. tomt och maxh\u00f6jd \u00e4r tv\u00e5 v\u00e5ningsplan, beroende p\u00e5 tomtens klassificering.<\/p>\n<p>e) Byggnationen ska uppfylla vissa andra villkor och den m\u00e5ste ligga max 25 meter fr\u00e5n tomtgr\u00e4nsen.<\/p>\n<p>f) Fastigheten m\u00e5ste vara egenf\u00f6rs\u00f6rjande av el och vatten och helst med f\u00f6rnybar energi, med vissa undantag.<\/p>\n<p>g) Det \u00e4r f\u00f6rbjudet att bygga p\u00e5 omr\u00e5den som kan \u00f6versv\u00e4mmas och vid skogsfastigheter m\u00e5ste s\u00e4rskilda garantier uppfyllas avseende brandrisk.<\/p>\n<p>h) Byggandet av bostaden ska vara f\u00f6renlig med den verksamhet som bedrivs p\u00e5 fastigheten (jordbruk osv).<\/p>\n<p>i) Bost\u00e4der som f\u00f6rhindrar grannfastigheternas verksamhet f\u00e5r inget tillst\u00e5nd, och d\u00e4rf\u00f6r ska \u00e4garna till grannfastigheterna h\u00f6ras innan tillst\u00e5nd kan ges.<\/p>\n<p>Sammanfattningsvis ger regelverket i Andalusien numera r\u00e4tt att bygga en bostadsfastighet p\u00e5 lantegendom under vissa villkor och efter att bygglov erh\u00e5llits fr\u00e5n byggnadsn\u00e4mnden i respektive kommun.
