Syftet \u00e4r att \u00e4garen eller hyresv\u00e4rden ska f\u00e5 tillbaka besittningen till fastigheten eller l\u00e4genheten. Grund f\u00f6r vr\u00e4kning kan vara att hyresg\u00e4sten inte betalt hyran eller likst\u00e4llda belopp, s\u00e5som t.ex. avgiften till samf\u00e4llighetsf\u00f6reningen eller el- och vattenf\u00f6rbrukningen. En annan grund kan vara att hyresavtalet har l\u00f6pt ut men hyresg\u00e4sten v\u00e4grar att flytta ut. Genom ett vr\u00e4kningsf\u00f6rfarande pr\u00f6vas ocks\u00e5 talan att \u00e5terf\u00e5 besittningen n\u00e4r det g\u00e4ller en fastighet som \u00f6verl\u00e5tits utan avtal, s.k. en precario.<\/p>\n<p><strong>Vid vr\u00e4kning p\u00e5 grund av utebliven betalning av hyran eller likst\u00e4llda belopp, kan \u00e4garen:<\/strong><\/p>\n<p>a) Ans\u00f6ka hos domstolen att bostaden eller lokalen l\u00e4mnas tillbaka, d.v.s. att personen flyttar ut och \u00e4garen \u00e5terf\u00e5r egendomen<\/p>\n<p>b) ut\u00f6ver beg\u00e4ran att \u00e5terf\u00e5 besittningen, \u00e4ven kr\u00e4va hyresg\u00e4sten p\u00e5 de belopp som denne \u00e4r skyldig.<\/p>\n<p>Oavsett om du \u00f6nskar kr\u00e4va p\u00e5 endast besittningen eller ocks\u00e5 p\u00e5 obetalda belopp, sker kravet genom inl\u00e4mnande av st\u00e4mningsans\u00f6kan till domstol med yrkande att hyresg\u00e4sten inte har uppfyllt sin skyldighet att betala hyran eller andra obetalda r\u00e4kningar som t.ex. f\u00f6r el och vatten, och s\u00e5lunda m\u00e5ste flytta fr\u00e5n fastigheten samt krav p\u00e5 betalning av de belopp som hyresg\u00e4sten \u00e4r skyldig.<\/p>\n<p>Domstolen delger hyresg\u00e4sten st\u00e4mningsans\u00f6kan, som har 10 dagar p\u00e5 sig att svara. Om hyresg\u00e4sten inte bestrider talan inom angiven tid, beh\u00f6ver inte n\u00e5gon r\u00e4tteg\u00e5ng h\u00e5llas utan domstolen kan direkt besluta om avhysning och verkst\u00e4llighet och indrivning av skulden.<\/p>\n<p>Om hyresg\u00e4sten ist\u00e4llet bestrider talan, kallas till huvudf\u00f6rhandling (r\u00e4tteg\u00e5ng). B\u00e5da parter f\u00e5r d\u00e5 r\u00e4tt att yrka p\u00e5 sina krav och framst\u00e4lla sina grunder och argument f\u00f6r respektive inst\u00e4llning samt framl\u00e4gga sin bevisning. D\u00e4refter avkunnar domstolen sin dom. Om hyresv\u00e4rden vinner m\u00e5let beslutas om datum f\u00f6r avhysning och verkst\u00e4llighet, f\u00f6rutsatt att hyresg\u00e4sten inte redan flyttat ut.<\/p>\n<p>Hyresg\u00e4sten kan stoppa vr\u00e4kningen genom att betala de belopp som denne \u00e4r skyldig j\u00e4mte r\u00e4nta och r\u00e4tteg\u00e5ngskostnader. Hyresg\u00e4sten m\u00e5ste d\u00e5 g\u00f6ra betalningen inom 10 dagar fr\u00e5n att hen erh\u00e5ller st\u00e4mningsans\u00f6kan och d\u00e4refter forts\u00e4tter hyresavtalet att g\u00e4lla och hyresg\u00e4sten f\u00e5r s\u00e5lunda bo kvar till hyrestiden g\u00e5r ut enligt villkoren i avtalet. Denna r\u00e4ttighet kan bara anv\u00e4ndas en g\u00e5ng. D.v.s. om hyresg\u00e4sten undvikit vr\u00e4kning en g\u00e5ng genom att betala sin skuld, har hen inte r\u00e4tt att anv\u00e4nda samma r\u00e4ttighet om hen blir st\u00e4md \u00e5terigen f\u00f6r utebliven betalning.<\/p>\n<p>Som i de flesta domstolsprocesser i Spanien \u00e4r det ett krav att parterna har en abogado (spansk advokat) och procurador (s\u00e4rskilt r\u00e4tteg\u00e5ngsombud) som representerar dig och f\u00f6r talan inf\u00f6r domstolen.<\/p>\n<p>Det \u00e4r alltid sv\u00e5rt att uppskatta handl\u00e4ggningstiden i domstols\u00e4renden, d\u00e5 det kan bero p\u00e5 i vilken domstol som \u00e4rendet handl\u00e4ggs och omst\u00e4ndigheterna i det s\u00e4rskilda fallet, men generellt \u00e4r det v\u00e5r erfarenhet \u00e4r denna typ av domstols\u00e4renden och vr\u00e4kning brukar p\u00e5g\u00e5 cirka 9-18 m\u00e5nader.<\/p>\n<p>Vi har l\u00e5ng erfarenhet av handl\u00e4ggande av \u00e4renden i spansk domstol och spansk processr\u00e4tt.
