Plan \u2013 och Bygglagen). I Andalusien finns egen lagstiftning i \u00e4mnet, Ley 7\/2021, kort kallad LISTA. En finca r\u00fastica \u00e4r en fastighet eller tomt som ligger utanf\u00f6r stadsplanelagt omr\u00e5de och kan likst\u00e4llas med lantegendom, det handlar allts\u00e5 om en jordbruksfastighet, skogsfastighet och liknande. En fastighet som ligger inom detaljplanen som stadsplanelagt omr\u00e5de \u00e4r ist\u00e4llet en finca urbana, vilket betyder att det \u00e4r en tomt som man f\u00e5r bygga p\u00e5. Den st\u00f6rsta skillnaden mellan de tv\u00e5 \u00e4r s\u00e5lunda att en finca rustica \u00e4r en del av mark d\u00e4r grundregeln \u00e4r att de inte f\u00e5r bebyggas, med vissa undantag.<\/p>\n<p>En finca urbana d\u00e4remot \u00e4r tomt eller byggnader p\u00e5 en del av mark d\u00e4r man har r\u00e4tt att bygga efter erh\u00e5llande av bygglov och andra tillst\u00e5nd.<\/p>\n<p>Klassificeringen av mark som lantegendom eller stadsplanelagd mark definieras i de ovan n\u00e4mnda lagarna och \u00e4ven i de allm\u00e4nna planeringsdokument som respektive kommun uppr\u00e4ttar, antingen i kommunens detaljplan eller i kompletterande normer.<\/p>\n<p>Ur stadsplaneringssynpunkt \u00e4r finca r\u00fastica en mark som saknar den infrastruktur som skulle g\u00f6ra den till en tomt som \u00e4r l\u00e4mplig f\u00f6r bebyggelse. M\u00f6jligheterna att bygga p\u00e5 en lantegendom \u00e4r d\u00e4rf\u00f6r mycket begr\u00e4nsade i lagen.<\/p>\n<p><strong>Lantegendomarna delas in i f\u00f6ljande kategorier:<\/strong><\/p>\n<p>a) Lantegendom s\u00e4rskilt skyddad genom sektoriell lagstiftning.<\/p>\n<p>b) Lantegendom som inte kan omvandlas till bebyggelse p.g.a. f\u00f6rekomst av naturliga processer eller antropogena aktiviteter som medf\u00f6r risker, vilket g\u00f6r de inte kan bebyggas s\u00e5 l\u00e4nge dessa risker finns kvar.<\/p>\n<p>c) Lantegendom som inte kan omvandlas till bebyggelse av sk\u00e4l som r\u00f6r h\u00e5ll &#8211; barhet, f\u00f6rnuft och l\u00f6nsamhet enligt kommunens f\u00f6ruts\u00e4ttningar.<\/p>\n<p>d) allm\u00e4n lantegendom, omfattar resten av den mark som b\u00f6r betraktas som lantegendom.<\/p>\n<p>P\u00e5 lantegendom kan byggnation av frist\u00e5ende enfamiljshus till\u00e5tas, under f\u00f6ruts\u00e4ttning att de inte leder till att nya bos\u00e4ttningar bildas och p\u00e5 villkor att byggherren eller \u00e4garen som bygger betalar 15 % av kostnaden f\u00f6r det materiella utf\u00f6randet av arbetena till kommunen.<\/p>\n<p>Det \u00e4r ocks\u00e5 m\u00f6jligt att regularisera olagliga bos\u00e4ttningar p\u00e5 landsbygden genom en s\u00e4r &#8211; skild process i enlighet med lagen Decreto Ley 3\/2019, d\u00e5 framf\u00f6rallt om mycket bebyggelse gjorts i samma omr\u00e5de.<\/p>\n<p><strong>N\u00e4r det g\u00e4ller finca urbana \u00e4r det tomter som integreras i staden och som m\u00e5ste uppfylla n\u00e5got av f\u00f6ljande villkor:<\/strong><\/p>\n<p>a) det ska finnas tillr\u00e4cklig infrastruktur<\/p>\n<p>b) det ska finnas v\u00e4gar och anslutning till vattenf\u00f6rs\u00f6rjning, avlopp och elf\u00f6rs\u00f6rjning<\/p>\n<p>c) minst tv\u00e5 tredjedelar av den yta som \u00e4r l\u00e4mpad f\u00f6r detta \u00e4ndam\u00e5l m\u00e5ste upptas av bebyggelse<\/p>\n<p>d) traditionella bos\u00e4ttningar p\u00e5 landsbygden som \u00e4r lagligt etablerade i landsbygdsmilj\u00f6n, under f\u00f6ruts\u00e4ttning att det finns v\u00e4gar och grundl\u00e4ggande infrastruktur och anslutning till el, vatten och avlopp.<\/p>\n<p>N\u00e4r du ska k\u00f6pa en mark rekommenderas det att beg\u00e4ra ut fr\u00e5n kommunens byggnadsavdelning ett intyg d\u00e4r det framg\u00e5r hur marken i fr\u00e5ga klassificeras och eventuella begr\u00e4nsningar i nyttjandet.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Vi f\u00e5r m\u00e5nga fr\u00e5gor om skillnaden p\u00e5 en finca r\u00fastica och en \u201dvanlig fastighet\u201d och vad man f\u00e5r bygga m.m.
