Det \u00e4r en hel del kontroller som beh\u00f6ver g\u00f6ras f\u00f6r att undvika obehagliga \u00f6verraskningar, d\u00e5 inte register samk\u00f6rs p\u00e5 samma s\u00e4tt som i Sverige. En viktig sak att ha i \u00e5tanke \u00e4r ocks\u00e5 att m\u00e4klaren ofta har en annan roll \u00e4n. Det finns inget krav i Spanien att m\u00e4klare ska vara auktoriserad eller utbildad (\u00e4ven om de kan vara det) och de har d\u00e4rf\u00f6r inte samma ansvar enligt lag som i Sverige. M\u00e5nga g\u00e5nger agerar m\u00e4klaren endast som f\u00f6rmedlare vid k\u00f6p och f\u00f6rs\u00e4ljningen. Det medf\u00f6r att respektive part, k\u00f6pare och s\u00e4ljare, beh\u00f6ver anlita egna juridiska ombud.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">L\u00e4genheter i Spanien \u00e4r fast egendom och \u00e4r s.k. \u00e4gandel\u00e4genheter. L\u00e4genheter, radhus, lokaler och i vissa fall frist\u00e5ende villor ing\u00e5r oftast i en samf\u00e4llighetsf\u00f6rening, s.k. Comunidad de Propietarios, som f\u00f6rvaltar alla allm\u00e4nna omr\u00e5den; tr\u00e4dg\u00e5rd, trappuppg\u00e5ng, poolomr\u00e5de, fasad etc.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Ovanst\u00e5ende g\u00f6r bl.a. att kraven f\u00f6r registrering av \u00e4gander\u00e4tten skiljer sig n\u00e5got och man s\u00f6ker lagfart inte bara p\u00e5 frist\u00e5ende villor utan \u00e4ven p\u00e5 l\u00e4genhet, radhus, f\u00f6rr\u00e5d och garage och liknande. F\u00f6r att kunna s\u00f6ka lagfart kr\u00e4vs i Spanien att \u00f6verl\u00e5telsehandlingen signeras inf\u00f6r notarius publicus, vilket g\u00f6rs p\u00e5 spanska. Talar du inte spanska m\u00e5ste du d\u00e4rf\u00f6r ha med dig n\u00e5gon som \u00f6vers\u00e4tter och som intygar inf\u00f6r notarius publicus att du f\u00f6rst\u00e5r handlingen som du skriver p\u00e5. Du m\u00e5ste allts\u00e5 personligen n\u00e4rvara hos notarien, eller l\u00e4mna fullmakt till ditt ombud.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">I Spanien har k\u00f6paren en stor unders\u00f6kningsplikt. Fastigheter och l\u00e4genheter s\u00e4ljs oftast i befintligt skick och enligt de uppgifter som \u00e4r registrerade. Det \u00e4r d\u00e4rf\u00f6r viktigt att anlita juridisk hj\u00e4lp f\u00f6r att g\u00f6ra alla erforderliga unders\u00f6kningar. Exempelvis lagfart, servitut, hypotek, obetalda skatter, bygglov, ev. skulder f\u00f6r el och vatten samt hos samf\u00e4llighetsf\u00f6reningen (Comunidad) m.m.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">De allra flesta skatter och avgifter f\u00f6ljer egendomen, vilket betyder att den nya \u00e4garen kan bli tvungen att betala s\u00e4ljarens gamla skulder.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">Ett problem har tidigare ocks\u00e5 varit att m\u00e5nga fastigheter uppf\u00f6rts utan erforderliga bygglov och tillst\u00e5nd, eller att bygglov senare \u00e5terkallats d\u00e5 de strider mot g\u00e4llande planbest\u00e4mmelser. D\u00e4rf\u00f6r \u00e4r detta ocks\u00e5 n\u00e5got som b\u00f6r kontrolleras.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">Slutligen \u00e4r det ocks\u00e5 viktigt att t\u00e4nka igenom hur \u00e4garbilden skall se ut \u2013 om k\u00f6paren \u00e4r gift och i s\u00e5 fall om fastigheten ska vara gemensam eller enskild egendom, om det g\u00e4ller sambo, ev. barn osv. Det \u00e4r viktigt att ditt ombud, ut\u00f6ver spansk fastighetsr\u00e4tt, \u00e4ven har grundl\u00e4ggande kunskaper inom svensk ekonomisk familjer\u00e4tt, eftersom svensk r\u00e4tt kommer att styra det personliga r\u00e4ttsf\u00f6rh\u00e5llandet i egendomen.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p3\">Ett gott r\u00e5d \u00e4r d\u00e4rf\u00f6r att alltid v\u00e4nda sig till en v\u00e4lrenommerad byr\u00e5 som kan fastighetsr\u00e4tt i Spanien innan du skriver p\u00e5 n\u00e5got avtal eller betalar handpenning.
