Det \u00e4r att rekommendera att g\u00f6ra en besiktning av fastigheten n\u00e4r den \u00e4r f\u00e4rdigbyggd f\u00f6r att uppt\u00e4cka eventuella fel.<\/p>\n<p>I detta avseende kan vi skilja mellan, \u00e5 ena sidan, de fel som kan ses med blotta \u00f6gat och \u00e4r l\u00e4tta att uppt\u00e4cka och, \u00e5 andra sidan, s\u00e5 kallade dolda fel, som \u00e4r de sv\u00e5raste att uppt\u00e4cka eftersom de inte syns n\u00e4r fastigheten k\u00f6ps, utan kommer fram efter en tid.<\/p>\n<p>Oavsett vilken typ av fel de handlar om har \u00e4garen r\u00e4tt att kr\u00e4va att byggherren\/promotorn som s\u00e5lde fastigheten att denne \u00e5tg\u00e4rdar felen, \u00e4ven om ansvaret faller gemensamt och solidariskt p\u00e5 alla agenter som \u00e4r inblandade i byggprocessen (promotor, byggfirman, arkitekt och teknisk arkitekt).<\/p>\n<p>Lagen <em>Ley de Ordenaci\u00f3n de la Edificaci\u00f3n<\/em> reglerar de garantier som g\u00e4ller f\u00f6r byggnadsarbeten, de inblandade akt\u00f6rernas ansvar f\u00f6r de skador som orsakats och tidsfristerna f\u00f6r att kr\u00e4va dem.<\/p>\n<p>Akt\u00f6rerna ansvarar f\u00f6r:<\/p>\n<ul>\n<li>Under <strong>ett \u00e5r<\/strong> f\u00f6r materiella skador som orsakats av fel eller brister i utf\u00f6randet som p\u00e5verkar <strong>f\u00e4rdigst\u00e4llande och slutf\u00f6rande<\/strong> av arbetet och som \u00e4r m\u00e4rkbara med blotta \u00f6gat, s\u00e5som fel p\u00e5 d\u00f6rrar, f\u00f6nster och persienner, fel p\u00e5 golv och kakel, m\u00e5lning, sanitetsporslin etc.<\/li>\n<li>Under <strong>tre \u00e5r<\/strong> f\u00f6r materiella skador som orsakats av fel eller brister i <strong>byggnadsdelar eller installationer<\/strong> som p\u00e5verkar beboeligheten, som inte \u00e4r synliga f\u00f6rr\u00e4n fastigheten anv\u00e4nds, s\u00e5som uppkomst av fukt, fel i el, VVS, v\u00e4rme, luftkonditionering etc.<\/li>\n<li>Under <strong>tio \u00e5r <\/strong>f\u00f6r materiella skador som orsakas av fel eller defekter som p\u00e5verkar byggnadens <strong>strukturella element<\/strong>, s\u00e5som fundament, st\u00f6d, balkar, plattor, b\u00e4rande v\u00e4ggar eller andra strukturella element som \u00e4ventyrar bostadens b\u00e4rande stabilitet.<\/li>\n<\/ul>\n<p>De angivna perioderna b\u00f6rjar r\u00e4knas fr\u00e5n n\u00e4r byggnaden \u00e4r f\u00e4rdigbyggd. Om en viss tid redan har f\u00f6rflutit sedan fastigheten byggdes m\u00e5ste denna tid dras av fr\u00e5n var och en av de tre garantier som g\u00e4ller f\u00f6r fastigheten.<\/p>\n<p>N\u00e4r felet har uppt\u00e4ckts i fastigheten m\u00e5ste det anm\u00e4las till byggherren\/promotorn inom motsvarande garantiperioder (ett, tre eller tio \u00e5r).
