Detta d\u00e5 regleringen \u00e4r annorlunda f\u00f6r hyresavtal som avser semesterbost\u00e4der. Hyresavtal f\u00f6r bost\u00e4der styrs av de avtal, klausuler och villkor som \u00f6verenskommes mellan parterna, men alltid inom de ramar som fastst\u00e4lls i <em>Ley de Arrendamientos Urbanos<\/em> (LAU), avdelning II, och, i andra hand, i civillagen.<\/p>\n<h2><strong>Vilka r\u00e4ttigheter har den som hyr en bostad?<\/strong><\/h2>\n<p>&#8211; <strong><em>Hemmets okr\u00e4nkbarhet<\/em>:<\/strong> m\u00e5nga hyresv\u00e4rdar tror att eftersom fastigheten \u00e4r deras har de r\u00e4tt att g\u00e5 in i bostaden utan f\u00f6rvarning f\u00f6r att inspektera om allt \u00e4r i sin ordning. Men hyresv\u00e4rden har ingen r\u00e4tt att g\u00e5 in i hemmet om vi inte uttryckligen till\u00e5ter hen att g\u00f6ra det eller om det finns ett domstolsbeslut.<\/p>\n<p><strong><em>&#8211; F\u00f6rl\u00e4ngning av hyresavtalets l\u00f6ptid<\/em><\/strong>: \u00c4ven om hyresavtalets l\u00f6ptid \u00e4r den som parterna har kommit \u00f6verens om, n\u00e4r den avtalade l\u00f6ptiden \u00e4r kortare \u00e4n 5 eller 7 \u00e5r &#8211; beroende p\u00e5 om hyresv\u00e4rden \u00e4r en fysisk eller juridisk person &#8211; g\u00e4ller en obligatorisk \u00e5rlig f\u00f6rl\u00e4ngning f\u00f6r hyresv\u00e4rden n\u00e4r hyresavtalet har ing\u00e5tts, tills hyresavtalet har n\u00e5tt denna l\u00f6ptid. Efter denna obligatoriska f\u00f6rl\u00e4ngning finns det en automatisk f\u00f6rl\u00e4ngning som inneb\u00e4r att om ingen av parterna meddelar sin avsikt att inte forts\u00e4tta hyresavtalet (med 4 m\u00e5naders varsel f\u00f6r hyresv\u00e4rden eller 2 m\u00e5naders varsel f\u00f6r hyrestagaren), f\u00f6rl\u00e4ngs hyresavtalet med ett \u00e5r i taget upp till maximalt 3 \u00e5r.<\/p>\n<p><strong><em>&#8211; Upps\u00e4gning av kontraktet<\/em><\/strong>: under kontraktets l\u00f6ptid, oavsett dess l\u00e4ngd, n\u00e4r de f\u00f6rsta 6 m\u00e5naderna har g\u00e5tt, har hyresg\u00e4sten r\u00e4tt att l\u00e4mna bostaden utan att beh\u00f6va ange n\u00e5gon orsak, endast genom att meddela hyresv\u00e4rden 30 dagar f\u00f6re utflyttningsdagen, oavsett om denna omst\u00e4ndighet har avtalats i kontraktet eller inte. Hyresv\u00e4rden kan dock kr\u00e4va ers\u00e4ttning fr\u00e5n hyresg\u00e4sten, men detta m\u00e5ste uttryckligen anges i avtalet, och det maximala beloppet \u00e4r en m\u00e5nadshyra f\u00f6r varje \u00e5r som \u00e5terst\u00e5r av kontraktet, med en proportionell andel f\u00f6r perioder som \u00e4r kortare \u00e4n ett \u00e5r.<\/p>\n<p><strong><em>-Neds\u00e4ttning av hyran p\u00e5 grund av renovering:<\/em><\/strong> F\u00f6r att s\u00e4nka hyran p\u00e5 grund av renoveringsarbeten kr\u00e4vs att hyresg\u00e4sten ber\u00f6vas en del av bostaden. Det \u00e4r inte tillr\u00e4ckligt att hen f\u00e5r utst\u00e5 de ol\u00e4genheter och det obehag som eventuella arbeten kan medf\u00f6ra. N\u00e4r det g\u00e4ller underh\u00e5llsarbeten ger de hyresg\u00e4sten r\u00e4tt till hyresavdrag om de varar mer \u00e4n 20 dagar och ber\u00f6var hen en del av bostaden. N\u00e4r det g\u00e4ller f\u00f6rb\u00e4ttringsarbeten minskas hyran fr\u00e5n och med den dag de p\u00e5b\u00f6rjas och hyresg\u00e4sten kompenseras f\u00f6r de kostnader som uppst\u00e5tt.<\/p>\n<p><strong><em>-Utf\u00f6rande av underh\u00e5llsarbeten<\/em><\/strong>: Hyresv\u00e4rden \u00e4r skyldig att utf\u00f6ra n\u00f6dv\u00e4ndiga reparationer f\u00f6r att bevara bostaden i beboeligt skick, s\u00e5 att den kan tj\u00e4na den \u00f6verenskomna anv\u00e4ndningen.<\/p>\n<p><strong><em>-F\u00f6rk\u00f6psr\u00e4tt:<\/em><\/strong> Om bostaden bjuds ut till f\u00f6rs\u00e4ljning har hyresg\u00e4sten r\u00e4tt att f\u00f6rv\u00e4rva den framf\u00f6r andra m\u00f6jliga k\u00f6pare. Parterna kan dock ha kommit \u00f6verens om att avst\u00e5 fr\u00e5n denna r\u00e4tt.<\/p>\n<p><strong><em>-\u00c5terbetalning av depositionen<\/em><\/strong>: n\u00e4r avtalet skrivs under \u00e4r hyresg\u00e4sten tvungen enligt lag att betala en deposition, som m\u00e5ste \u00e5terbetalas till hyresg\u00e4sten n\u00e4r avtalet s\u00e4gs upp, f\u00f6rutsatt att fastigheten \u00e4r i gott skick och att inga hyror \u00e4r obetalda.<\/p>\n<p><strong><em>&#8211; Stoppande av vr\u00e4kning<\/em><\/strong>: En av orsakerna till att hyresv\u00e4rden kan vr\u00e4ka hyresg\u00e4sten \u00e4r att hyran eller likst\u00e4llda belopp (s\u00e5som betalning av el, vatten, IBI, kommunal fastighetsskatt etc.), inte betalats. Hyresg\u00e4sten kan i dessa fall undvika vr\u00e4kning och upps\u00e4gning av avtalet p\u00e5 grund av utebliven hyra, om betalning av de oreglerade beloppen g\u00f6rs inom tid som anges i lagen. Denna m\u00f6jlighet kan endast anv\u00e4ndas av hyresg\u00e4sten en g\u00e5ng under hela hyresavtalets l\u00f6ptid. Oaktat ovanst\u00e5ende, om hyresv\u00e4rden har kr\u00e4vt p\u00e5 betalning minst 30 dagar innan st\u00e4mningsans\u00f6kan l\u00e4mnades in till domstol och hyresg\u00e4sten inte gjort betalningen n\u00e4r st\u00e4mningsans\u00f6kan l\u00e4mnas, kan inte denna r\u00e4ttighet till\u00e4mpas.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>N\u00e4r du ska hyra en bostad i Spanien kan det dyka upp en hel del fr\u00e5gor, som till exempel: \u00c4r det obligatoriskt med deposition?
