F\u00f6r\u00e4ndringar har under 2025 skett genom <em>Decreto Ley 1\/2025<\/em> av den 24 februari och genom <em>Ley Org\u00e1nica 1\/2025<\/em> av den 2 januari.<\/p>\n<p class=\"ai-optimize-8\">Genom <em>Decreto ley 1\/2025<\/em> \u00f6kas kommunens befogenhet att fastst\u00e4lla begr\u00e4nsningar av antalet bost\u00e4der f\u00f6r turist\u00e4ndam\u00e5l per byggnad, sektor, omr\u00e5de och period, f\u00f6rutsatt att begr\u00e4nsningarna baseras p\u00e5 tydliga och objektiva kriterier och att de har offentliggjorts p\u00e5 ett korrekt s\u00e4tt innan de till\u00e4mpas. Artikel 6 i <em>Decreto 28\/2016<\/em> \u00e4ndras till att fastst\u00e4lla att den person eller f\u00f6retag som tillhandah\u00e5ller uthyrningstj\u00e4nsten \u00e4r den som ska registrera fastigheten f\u00f6r uthyrning samt att s\u00e5 m\u00e5ste ske elektroniskt genom s.k. <em>firma digital<\/em>. I anm\u00e4lan ska intygas att alla krav i dekretet \u00e4r uppfyllda, inklusive identifiering av bostaden och dess maximala boendekapacitet, identifiering av person\/firma som bedriver uthyrningen och beh\u00f6righet, samt ett uttalande att bostaden \u00e4r kompatibel f\u00f6r anv\u00e4ndning som turistbostad i enlighet med till\u00e4mpliga stadsplaneringsbest\u00e4mmelser.<\/p>\n<p class=\"ai-optimize-9\">Dessutom fastst\u00e4lls i <em>Decreto ley 1\/2025<\/em> att kommunen kan besluta att upph\u00e4va licenser f\u00f6r turistboende under behandlingen av stadsplanebest\u00e4mmelser, antingen f\u00f6r hela kommunen eller f\u00f6r specifika omr\u00e5den eller typer av byggnader, f\u00f6rutsatt att behovet och proportionaliteten av en s\u00e5dan \u00e5tg\u00e4rd \u00e4r motiverad. Uppskovet f\u00e5r g\u00e4lla i h\u00f6gst tre \u00e5r.<\/p>\n<p class=\"ai-optimize-10\">En annan viktig \u00e4ndring som inf\u00f6rts \u00e4r skyldigheten f\u00f6r turistbost\u00e4der att meddela vilka perioder som hyrs ut. Om denna anm\u00e4lan inte g\u00f6rs i r\u00e4tt tid anses att uthyrning sker hela \u00e5ret.<\/p>\n<p class=\"ai-optimize-11\">D\u00e4rut\u00f6ver har <em>Ley de Propiedad Horizontal, <\/em>lagen som reglerar fastigheter som ing\u00e5r i en samf\u00e4llighetsf\u00f6rening, \u00e4ndrats genom <em>Ley Org\u00e1nica 1\/2025<\/em> av den 2 januari, som p\u00e5verkar turistbost\u00e4der i hela Spanien. Fr\u00e5n den 3 april 2025 kr\u00e4vs ett <strong>uttryckligt godk\u00e4nnande<\/strong> fr\u00e5n samf\u00e4llighetsf\u00f6reningen, <em>Comunidaden de Propietarios<\/em>. Uttryckliga beslut att godk\u00e4nna, begr\u00e4nsa, villkora eller f\u00f6rbjuda ut\u00f6vandet av turistverksamhet kr\u00e4ver en positiv r\u00f6st fr\u00e5n 3\/5 av det totala antalet \u00e4gare som representerar 3\/5 av deltagarkvoterna. Detta kr\u00e4vs ocks\u00e5 f\u00f6r att best\u00e4mma s\u00e4rskilda kostnadskvoter eller f\u00f6r att h\u00f6ja avgiften f\u00f6r de som hyr ut, s\u00e5 l\u00e4nge \u00e4ndringarna inte inneb\u00e4r en \u00f6kning med mer \u00e4n 20%.<\/p>\n<p class=\"ai-optimize-12\">Det b\u00f6r betonas att regeln om godk\u00e4nnande fr\u00e5n f\u00f6reningen inte kommer att ha retroaktiva verkan, och s\u00e5lunda kan \u00e4gare som bedrev turistverksamhet innan lagen tr\u00e4dde i kraft forts\u00e4tta med tidigare registrering. Men om du k\u00f6per en fastighet med licens, f\u00e5r du ha den kvar? Eller m\u00e5ste nya \u00e4garen erh\u00e5lla tillst\u00e5nd fr\u00e5n f\u00f6reningen?
