GONVEL &amp; KAMPH<br \/>spanska advokater och skattera\u030adgivare info@gonvelkamph.net www.gonvelkamph.net<\/p><\/div>\n<p>I februari 2016 godk\u00e4nde <em>Junta de Andaluc\u00eda<\/em>, genom ett dekret, regleringen av <em>viviendas de uso tur\u00edstico<\/em>, bost\u00e4der f\u00f6r turist\u00e4ndam\u00e5l, och definierade dem som: \u201dbost\u00e4der utrustade p\u00e5 s\u00e4tt att de kan anv\u00e4ndas omedelbart, bel\u00e4gna i fastigheter d\u00e4r nyttjandet av bost\u00e4der f\u00f6r turist\u00e4ndam\u00e5l kommer att erbjudas till ett pris\u201d.<\/p>\n<p>F\u00f6rordningen lyckades inte f\u00f6rhindra den godtyckliga spridningen av denna typ av bost\u00e4der. Av denna anledning \u00e4ndrades 2016 \u00e5rs dekret genom ett nytt dekret som godk\u00e4ndes i januari 2024 och som tr\u00e4dde i kraft i augusti 2024, genom att inf\u00f6rlivade en rad krav f\u00f6r anpassning av turistbost\u00e4der som redan \u00e4r registrerade, vilket mer utt\u00f6mmande specificerar de krav som dessa bost\u00e4der m\u00e5ste uppfylla f\u00f6r att kunna bedriva verksamheten.<\/p>\n<p>F\u00f6r det f\u00f6rsta \u00e4ndrades termen \u201dbost\u00e4der f\u00f6r turist\u00e4ndam\u00e5l\u201d till \u201dbost\u00e4der f\u00f6r turistbruk\u201d, vilket betonar anv\u00e4ndningen av fastigheten och inte syftet.<\/p>\n<p>Dessutom fastst\u00e4lls att de perioder d\u00e5 turistverksamheten bedrivs i fastigheten m\u00e5ste meddelas och att verksamheten inte f\u00e5r bedrivas utanf\u00f6r fastst\u00e4llda perioder.<\/p>\n<p>Om administrationen av uthyrningen sk\u00f6ts av ett uthyrningsf\u00f6retag eller m\u00e4klare, m\u00e5ste denne enligt de nya reglerna registrera sig som innehavare av licensen.<\/p>\n<p>I f\u00f6rordningen fastst\u00e4lls att bost\u00e4dernas kapacitet m\u00e5ste verifieras, varvid en minsta yta p\u00e5 14 m<sup>2<\/sup> per person och en minimum boyta p\u00e5 25 m<sup>2<\/sup> fastst\u00e4lls.<\/p>\n<p>N\u00e4r det g\u00e4ller badrummen m\u00e5ste antalet tillg\u00e4ngliga badrum i bostaden ocks\u00e5 meddelas, minst tv\u00e5 badrum f\u00f6r fem personer eller tre badrum om kapaciteten \u00e4r f\u00f6r mer \u00e4n \u00e5tta personer.<\/p>\n<p>Vardagsrummet och sovrummen m\u00e5ste ha direkt ventilation ut\u00e5t eller till ventilerade uteplatser och ett system f\u00f6r m\u00f6rkl\u00e4ggning av f\u00f6nstren. Dessutom ska de vara utrustade med luftkonditionering och v\u00e4rme.<\/p>\n<p>K\u00f6ket m\u00e5ste vara utrustat med minst tv\u00e5 spisplattor, ugn eller mikrov\u00e5gsugn och kylsk\u00e5p. K\u00f6ksutrustning som \u00e4r l\u00e4mplig f\u00f6r bostadens kapacitet ska tillhandah\u00e5llas, inklusive porslin, bestick, glas, stekpannor, kastruller etc. Sm\u00e5 elektriska apparater som mixer, br\u00f6drost, juicepress och kaffebryggare ska ocks\u00e5 tillhandah\u00e5llas. Alla dessa m\u00e5ste f\u00f6rvaras i de m\u00f6bler som finns f\u00f6r detta \u00e4ndam\u00e5l i k\u00f6ket. Dessutom ska reng\u00f6ringsredskap, kl\u00e4dstreck, strykj\u00e4rn och strykbr\u00e4da finnas och system f\u00f6r sopsortering m\u00e5ste implementeras. N\u00e4r det g\u00e4ller s\u00e4kerhet m\u00e5ste k\u00f6ket vara utrustat med en r\u00f6kdetektor och brandsl\u00e4ckare.<\/p>\n<p>N\u00e4r det g\u00e4ller sovrummen best\u00e4ms minimim\u00e5tten p\u00e5 s\u00e4ngarna, som ska vara minst 80 x 190 cm f\u00f6r enkels\u00e4ngar eller 135 x 190 cm om de \u00e4r dubbels\u00e4ngar och madrasserna ska ha en tjocklek p\u00e5 minst 18 cm.
