R\u00e4tten sl\u00e5r fast att den som k\u00f6per en turistbostad endast beh\u00f6ver byta namn p\u00e5 licensen och inte registrera fastigheten p\u00e5 nytt.\u00a0<\/strong><\/p>\n

Generaldirektoratet f\u00f6r r\u00e4ttss\u00e4kerhet och offentlig tilltro har n\u00e5tt en resolution som avg\u00f6r en viktig fr\u00e5ga knuten till f\u00f6rs\u00e4ljningen av turistl\u00e4genheter i Andalusien. Detta inneb\u00e4r att registreringen av en l\u00e4genhet f\u00f6r turistuthyrning \u00e4r kopplad till fastigheten och inte individen som \u00e4ger den. Med andra ord inneb\u00e4r det att den som k\u00f6per en l\u00e4genhet som \u00e4r registrerad f\u00f6r uthyrning till turister kan forts\u00e4tta anv\u00e4nda den till detta \u00e4ndam\u00e5l utan att registrera den p\u00e5 nytt hos de andalusiska myndigheterna.\u00a0<\/span><\/p>\n

Advokaten Jacob Sala kommenterar p\u00e5 LinkedIn att detta beslut \u201cs\u00e4kerst\u00e4ller kontinuiteten i r\u00e4tten att driva turistboende, skyddar fastighetsinvesteringar och st\u00e4rker \u00e4garnas r\u00e4ttss\u00e4kerhet\u201d.\u00a0<\/span><\/p>\n

Beslutet kommer efter ett \u00f6verklagande d\u00e4r \u00e4garen till en semesterfastighet i Torremolinos fick godk\u00e4nnandet att hyra till turister upph\u00e4vt eftersom den tidigare \u00e4garens namn fanns p\u00e5 tillst\u00e5ndet. Under en l\u00e5ng tid med flera \u00f6verklaganden stod det initiala beslutet fast men i maj f\u00f6rra \u00e5ret skickades \u00e4rendet vidare till generaldirektoratet. D\u00e4r gjordes en ny bed\u00f6mning som inneb\u00e4r att en bostads status som turistbostad beror p\u00e5 fastighetens efterlevnad av de lagstadgade kraven och \u00e4r inte bundet till vem som \u00e4ger den f\u00f6r stunden.\u00a0<\/span><\/p>\n

Detta har dessutom st\u00f6d i den r\u00e4ttspraxis som kommer fr\u00e5n h\u00f6gsta domstolen som g\u00f6r tydlig skillnad p\u00e5 licenser som \u00e4r kopplade till en person eller till egendom.\u00a0<\/span><\/p>\n

Juan Cubo, som \u00e4r ordf\u00f6rande i den andalusiska f\u00f6reningen f\u00f6r turistboenden (AVVA-Pro), \u00e4r \u201cmycket positiv\u201d till den nya bed\u00f6mningen. Han betonar att den \u201cbekr\u00e4ftar ett viktigt kriterium f\u00f6r sektorn: turistregistrering \u00e4r bunden till fastigheten\u201d. Han \u00e4r glad att nya \u00e4gare snabbt och enkelt kan b\u00f6rja sin verksamhet genom att enkelt rapportera ett namnbyte p\u00e5 licensen ist\u00e4llet f\u00f6r att s\u00f6ka ett nytt tillst\u00e5nd. Han p\u00e5minner dock att nya \u00e4gare beh\u00f6ver s\u00e4tta sig in i eventuella regler som specifikt g\u00e4ller i byggnaden eller omr\u00e5det d\u00e4r fastigheten ligger.\u00a0<\/span><\/p>\n

Samtidigt som detta senaste beslut kommer forts\u00e4tter sektorn med turistbost\u00e4der att v\u00e4xa i regionen. Den 26 augusti visade det andalusiska turistregistret att antalet l\u00e4genheter som f\u00e5r hyras ut till bes\u00f6kare hade \u00f6verstigit 150 000.<\/span><\/p>\n

Sett till provins har M\u00e1laga flest med 86 557.\u00a0 D\u00e4refter f\u00f6ljer Cadiz med 21 178, Almeria med 12 815, Sevilla med 11 481, Granada med 9 587, Huelva med 4 073, Cordoba med 3 731 och Jaen med 928.\u00a0<\/span><\/p>\n
